 The Provision of the Ministry of Public Health of RKThe decree of the Government of the Republic of Kazakhstan N1117 from October 28, 2004The collection of acts of the President and the Government (CAPG) of RK, 2004, N41, pg. 529 According to the decree of the President of RK N 1449 from September 29, 2004 «On the measures of further perfection of RK public management system», the Government of the Republic of Kazakhstan provides:
1. To state the following:
2. To permit the Minister of Health of RK to have two vice-ministers. 3. To form the Committee of medical services quality control and charge it with the functions of the Ministry of Public Health of RK in the field of health standards control. 4. To reorganize the Committee of Pharmacy and pharmaceutical and medical industry of the Ministry of Public Health of RK by means of transformation of the Ministry of Public Health of RK to the Committee of Pharmacy and charge it with all the functions of the reorganized Committee, with the exception of pharmaceutical and medical industry regulation. 5. To reorganize the territorial subdivisions of the Committee of Pharmacy and pharmaceutical and medical industry of the Ministry of Public Health of RK by means of transformation to territorial subdivisions of the Committee of Pharmacy of the Ministry of Public Health, in accordance with the application N 1 to the present decree. 6. In the order, prescribed by the Law, the Ministry of Public Health of the Republic of Kazakhstan:
1) has to work out and include the project of constitution of the Committee of medical services quality control into the Government of the Republic of Kazakhstan up to December 1, 2004. 7. In accordance with the application 2, some solutions of the Government of the Republic of Kazakhstan must be recognized as expired. 8. The present decree becomes operative from the day of signing.

1. The Ministry of Public Health of the Republic of Kazakhstan (further – Ministry) is a central executive authority, which directs and, in the range stipulated by the Law, realizes The principal problems of the Ministry are: to create a state policy in the field of protection of population’s health, medical science, medical and pharmaceutical education; to organize supplying of population and treatment-and-prophylaxis organizations with safety, effective and qualitative medicines; to organize and develop international collaboration in the range of Ministry’s competence. The Ministry has the following agencies: the Committee of national sanitary-and-epidemiological control, the Committee of Pharmacy and the Committee of medical services quality control. 2. The Ministry implements its activity in accordance with the Constitution and the Law of the Republic of Kazakhstan, the acts of the President and the Government of the Republic of Kazakhstan, the other legal acts and the present Decree. 3. The Ministry is a juridical authority in the legal-organizational form of state institution. It has seals and stamps with its own appellations in official language, fixed forms, and according to the Law, bank accounts in the Exchequer agencies of the Ministry of Finance of RK. The Ministry starts civil terms in its own name. In case of authorizing by the Law the Ministry has a right in the name of the state to be one of the parts in civil terms. 4. The Ministry takes solutions in the range of its competence, which are formalized by the orders of the Minister and valid on the territory of Kazakhstan. 5. The Government of the Republic of Kazakhstan confirms the limit of state number of the Ministry.
6. The legal address of the Ministry of Public Health is: 7. The full name of the Ministry is the National Institution “Ministry of Health of the Republic of Kazakhstan”. 8. The constituent instrument of the Ministry is the present Decree. 9. The financing of the Ministry is being realized at the Republic budget’s expense. The Ministry is not allowed to agree with business owners on question of charging them with the obligations, which belong to the Ministry’s functions. If legislative acts give the Ministry a right to realize repaid activity, profits have to be sent to the Republic budget. 2. The Functions and the rights of the Ministry 10. In accordance with the Law of the Republic of Kazakhstan, the Ministry implements the following:
1) strategic functions, ensuring formation of national policy on: development and confirmation (if in the range of its competence) of normative-legal acts on: physical body’s and health care organizations’ accreditation, logistical and medical support of the national health care organizations, in the field of medicines’ turn-over, in the field of medical services’ quality control – that is identification of registration order of infection, parasitic, industrial and the other diseases and poisonings, and the order of sanitary-and-epidemiological monitoring conduct; development of the list of free, guaranteed medical assistance’ volume; guaranteeing of development of medical science and coordination of scientific activity in the field of health care; realization of methodological leadership; activity of sanitary-and-epidemiological service on supplying with sanitary-and-epidemiological prosperity on the territory of Kazakhstan; activity in the field of medicines turn-over; activity in medical services quality control; realization (in the range of its competence) of coordination of activity of health care organizations, medical and pharmaceutical education organizations and the other national authorities and organizations; development and confirmation of normative-legal acts in the field of medical services quality control, including intrahospital management and estimation of health care organizations’ work effectiveness; development and confirmation of standards in the field of health care, including medical and pharmaceutical education; development and confirmation of health care organizations’ nomenclature, condition of their activity, their structures, standard states and state normatives, and nomenclature of medical positions and specialties; development and confirmation of normatives of volume and level of medical care for population, kinds and volumes of primary, qualified stationary, specialized and high-qualified medical care, restorative treatment and medical rehabilitation; development and confirmation of the forms of conducting of registration medical documentation in rendering of paid services to citizens and sectoral system of encouragement; working out measures of health care reprocessing by means of development of medical science’ privilege directions and organization of introduction and development of scientific researches’ results in treatment-and-prophylaxis organizations’ practice; confirmation of the National pharmacopoeia, National register of medicines and normative-technical documents on medicines; confirmation of the list of the essential medicines, kinds of diseases and separate categories of population, for whom medicines and special clinical nutrition are released free or on preferential terms according to receipt in out-patient treatment; confirmation of the list of diseases and health disorders, when sanatorium-and-spa treatment with definition of outpatient organizations’ categories is prescribed, and the order of medical care rendering and supplying with medicines; analysis and generalization of practice of law use in the sphere of citizen’s health protection and development of proposal of its perfection; fixing of order of qualification exams conduct; working out of the policy in the sphere of accreditation and privatization of health care objects;
development of policy of population’s immunization and defense of the Kazakhstan territory from delivery and spreading of specially dangerous and quarantine infectious diseases; preparation of projects and, in order, fixed by the Law, making of international contracts and agreements in the sphere of health care and medical and pharmaceutical education; 2) functions, guaranteeing realization of national policy in the sphere of: interaction and collaboration in the field of its activity with international organizations on implementation of international contracts, where one of the partners is the Republic of Kazakhstan; organization of rendering of free medical assistance and supplying with medicines and products of medical purpose for people in extreme situations; analysis of population’s level of health, conducting of activity in development and organization of collection and processing of medical-statistical information, perfection of accounting medical documents and guaranteeing of conducting of national statistical accounting and reporting in the field of health care;
guaranteeing of creation and functioning of the Republic informational and communicational systems in the field of health care;
organization and conducting of training and professional development of health care personnel; analysis and prediction of population’s birth and death rates; within its competence realization of planning and organization of mobilization training, national secrets’ defense and detection of necessary conditions for fulfillment of mobilization tasks and activities in the sphere of health care. 11. For the purpose of major tasks and its functions realization, within its competence, Ministry in the order, fixed by the Law, has a right: 1) to inquire about and receive information on questions in the range of its competence from national authorities, other organizations and officials; 2) to implement interaction with public organizations, intersectoral and inter-regional coordination on realization of national, sectoral and other programs of population’s health protection; 3) to grant national awards of the Republic of Kazakhstan to medical workers, who make special contribution to people’s health protection and health care development; 4) to conduct meetings, seminars, conferences and international symposiums on the problems within the Ministry’s competence; 5) to take standard-legal acts on problems of Ministry’s competence; 6) in order to coordinate scientific researches in the field of health care, to create advisory body – scientific council on health care problems, which consists of key scientists and specialists of medicine;
7) for special merits in people’s health protection to grant medical workers with 9) submit an order on competition’s development in the field of health care. 3. The Property of the Ministry 12. The Ministry has its own property on operating control privilege. 13. The property of the Ministry belongs to the Republic property. 14. The Ministry doesn’t have a right to alienate (or somehow else dispose) with property, assigned to it. The Ministry can be given a right to dispose with its property in cases and limits, fixed by the Law. 4. Organization of the Ministry’s activity. 15. The Ministry is headed by a Minister, which can be assigned or relieved from the post by the President of the Republic of Kazakhstan. The Minister has two deputies – vice-ministers, which can be assigned to the posts and relieved from them by the Government of the Republic of Kazakhstan. Note. In accordance with the resolution of The Government ¹ 134 from February 27, 2006, some changes were included in point 15. 16. The Minister organizes and leads the work of the Ministry, is personally liable for performance of tasks, entrusted to the Ministry, and realization of his functions. 17. For these purposes the Minister: 1) confirms the structure of the Ministry as well as assigns responsibilities and the range of powers for the vice-ministers and leaders of structural subdivisions of the Ministry; 2) assigns to and relieves from the posts the workers of the Ministry and the leaders of lower organizations; 3)in the order, fixed by the Law, solves the problems of incentives and material help rendering, and imposes disciplinary punishments on the Ministry’s workers; 4) according to the present Law, the minister is a representative of the Ministry in all relations with public bodies and other organizations; 5) signs orders; 6) affirms dispositions of the structural subdivisions of the Ministry; 7) realizes the other powers according to the Law of the Republic of Kazakhstan. 18. There is creating an advisory body in the Ministry – the board, numerical and personnel structure of which has to be confirmed by the Minister. Solutions of the Boards are legalizing by decrees and can be realized by the orders of the Minister. 5. Reorganization and liquidation of the Ministry. 19. Reorganization and liquidation of The Ministry can be realized according to the Law of the Republic of Kazakhstan.
